Jack Thompson Seeks to Have Halo 3 Declared a Public Nuisance in Florida

Jack Thompson Seeks to Have Halo 3 Declared a Public Nuisance in Florida

September 21, 2007
With the video game event of the year - the Halo 3 launch - just days away, game-hatin' attorney Jack Thompson is apparently seeking to re-create one of his greatest non-triumphs.

Although he failed miserably with a similar bid against Rockstar's Bully in 2006, Thompson hopes to have a Florida court declare Halo 3 a public nuisance. He promised as much late last year (see: Jack Thompson Vows More Public Nuisance Suits Against Games in 2007).

No surprise, really, that Halo 3 is in the media-hungry attorney's crosshairs. Thompson seems to prefer rattling his saber when high-profile game releases are involved. In his latest attention grab Thompson has released the text of what appears to be a court filing in the 11th Circuit, the same jurisdiction in which he failed embarrassingly during last year's Bully case.

Once again, Thompson is basing his claim on a Florida statute which defines public nuisances as that which:
...tend[s] to annoy the community, injure the health of the citizens in general, or corrupt the public morals

To get an idea of what the public nuisance law was really designed for, the types of places named in the statute include:
...any house or place of prostitution, assignation, lewdness or place or building where games of chance [i.e., gambling] are engaged in violation of law or any place where any law of the state is violated, shall be deemed guilty of maintaining a nuisance...

GP: Not a video game retailer in the bunch.

As with Bully, Thompson clearly hopes the court will grant him a hearing. Although after last year's well-publicized Bully performance, which earned Thompson a Bar complaint from presiding Judge Ronald Friedman, that seems unlikely.

More troubling by far are the long term implications of this action. Thompson apparently feels emboldened to invoke Florida's public nuisance law against any video game he desires to target. That is the essence of censorship and the video game industry cannot allow it to continue on any number of grounds - legal, moral or creative.

The full text of Thompson's complaint is here (MS Word format)...

Comments

I would have to say that Jack Thompson is the real public nuisance.
I don't believe this, he couldn't stop bully and he thinks he can stop one of the most hyped games in existence
Just like his previous efforts, this will end up at best with him being ignored and at worst giving him an opportunity to further dig his (in)credibilty hole.

Congratulations, Jack. Your pathetic, irrelevant flailings are a great source of humor to us all.
Way to go, trying to ride Halo 3's mass hype.

Knowing the Halo franchise's community, Jack is in for a whole world of hurt by attempting to mess with such a high profile release.

Think they're bad on Xbox Live? Wait until they get news of this... It might get rowdy.
@ oni

don't bother, he'll do it anyway.
So can anyone in the know tell me what happens when he loses his license? Hes filed this suit presumably with the intention of acting for himself, but when he can no longer do this, will he have to forfeit?
so whens the countdown till Microsoft buries him start?
Isn't there a law against waisting the courts time by filing "I-know-this-will- get-no-where-but-it'll-get-me-in-the-media-spotlight-so-I'll-do-it-anyway- cause-all-I-care-about-is-making-myself-look-good" cases? If there isn't then there should be.

Thompson should not be allowed to waste the courts time when there are more serious issues at hand. Try and do some *real* good with what little time you have left with your life, Jack.
He isn't serious is he? I mean come on didn't he learn anything from the Bully case.
Yes because pissing off some of the biggest companies in the world, and a man whos net worth is more than some small countries GNP is just a smashing idea. Seriously has jack accepted that he's done now and just want to go out with a massive bang? Because that's the only reason I can think of doing something this massivly stupid.
Ok, now we can plainly see Jack Thompson's lies:

11. The proof as to the causal nexus between violence simulation video games and real-world violence is legion, but one of the more notable proofs is found in the August 2005 Report of the American Psychological Association that establishes the direct causal link between violent teenaged video game play and teenagers’ aggression. The recent U. S. Supreme Court case of Roper v. Simmons, which struck down the juvenile death penalty, cites the brain scan studies similar to those coming out of Harvard, Indiana, and Michigan State Universities that prove that these violent games are processed in a different part of the brain in adolescents and teens than in adults, and it is the sector of the brain that leads of teen violence copycatting these violent games like Halo 3.

So far there has been no causal link, no evidence, no Legal Cases that can support any of this, yes there is evidence of a heightened sense of aggression after playing a violent game, but that's it. No basis for this claim what so ever.
Jack honestly thinks he's still the anti-game bogeyman; that everytime he threatens to move against an upcoming video game, we're all going to shake in our shoes. "Oh no, Peter Cottontop is back! What are the chances he'll succeed... this time?" No, Jack. No. We're not scared of you. We never had a reason to be scared.

Also, there's something hilarious and ambiguously wrong about the phrase "rattling his saber".
Now that I've read the case itself, some reactions:

Now he's not only claiming that Lee Malvo trained in sniping on Halo, but that the Army uses it to train snipers? IIRC, Halo doesn't even simulate gravity on sniping weapons. The base rule is pull the trigger when it's in your crosshoirs, which hardly seems to qualify as training. (point 9)

"Video game" should be hyphenated in point 11.

Point 12: This is one of the sadder attempts at spin I've seen. Recognizing something may not be good for kids isn't the same thing as community harm and recognizing parents will throw a fit isn't the same thing as copping to any sort of harm. Do we ban roller coasters because you must be a certain height to ride? Do we take the fact that libraries are typically separated into adults' and kids' books as a sign the adult books are dangerous and should be banned?

Point 14: I Best Buy is in violation of an out-of-court settlement (and I think he's mischaracterizing this), the thing to do would be to bring a civil suit specifically against them, not a public nuisance suit to ban a game. This is beyond the points that were amde earlier abotu the FTC considering cred cards valid for age verification as minors can't get them without parent/guardian approval. If they don't want Junior looking at porn and Halo, they can just not sign the form.

Point 15: This is the crux of his claim that Halo 3 itself, rather than Best Buy is a public nuisance, yet he backs it up only with a vague reference to news reports. Aren't you supposed to cite evidence?

Point 16: Again, what do false claims have to do with a nuisance suit? This sounds more like an issue for the FTC than the local courts.

Point 17: Prohibiting Microsoft from selling indirectly to anyone under 17 amounts to prohibiting them from selling it at all. Since hasn't named mail-order outlets beyond Best Buy in the case, presumably it would be Microsoft's job to make sure Amazon didn't sell to some kid in Pennsacola.

Overall: note the lack of any specific claims about Halo 3 or explanations why it falls under the public nuisance statute beyond vague claims that it's violent. He does cite (misleadingly) some studies on the matter, but does nothing to demonstrate these studies would apply to Halo 3. The closest he comes is citing a news story that the Beltway Sniper played Halo.

If he's lucky, the court will reject this at the first hearing, minimizing the damages Microsoft can counter-sure for.
@ Devestator3388: foreign corporation means they are incorporated in another state. Washington for Microsoft and Minnesota for Best Buy.
Sorry for the double post.

Let's not forget about the Florida residents that pre-ordered Halo 3.
I nearly laughed up a lung when I saw Jack's complaint. Not because of his usual lies (which annoy me more than amuse me), but because he apparently thinks Halo 3 will not be out for another month.

Better work fast, Jacko! Use those lightning-quick massacre chaser reflexes!
Possible other titles for this article:

-Jack Thompson: Out of ammunition
-Jack Thompson, Still Crazy

To JT, when he appears:
I can't believe you have dropped so low that you will attack one of the most popular franchises that has had no negative light in the media. Just leave the public eye immediately or accept your Bar complaints and become an unemployed ex-lawyer.

Sincerely,
J-Guy
I can honestly see that if Halo 3 is banned in Florida, Jack Thompson won't have to worry about people at Take 2 coming to get him...

Oh, thats not a statement that only gamers would do something like that. If the Dolphins (god forbid) make it to the Superbowl, and Jackie-boy here decides to get it banned because its a "public nuisance", I could see some chair jockeys getting up and finding where he lives. Then again, wouldn't be hard...the guy posts his personal info every 3-4 comments he makes.

Come on...Halo 3? Its not even that violent of a game! And who has ever said "Halo made me do it"? Go back to finding ways to keep your sanity, as well as your lawyer status, under control...because I know one is almost gone, and the other is sure to follow.
I think he will look very foolish when people leave EB games or Best buy with copies of Halo 3 next week.

That said, I hope the judge allows the hearing to go through, so that he can have his say, and Microsoft can have their say and absolutely crush him. Then the Bar can look at this and see how incompetent he is and dismiss him from the Bar, therefore, ending his career.

Oh, and don't bother looking north of the border for a new job, we won't take you
Actually, you know what? Forget that, he did go after The Sims 2 before, so this isn't as shocking now that I think of it, lol. But, it's still sad nonetheless.
I thought their curfew was 8PM EST? oh, the things i could come up with using photoshop and the intarweb.... lol
@Iniquus:

"2)It’s so much more fantasy than realism, that you’d have to be mentally undevelloped/ill to be influenced by it."

... which would explain JT's problem with HALO 3.

@Seany-boy:

"Jack hasn’t written because good Christians are in bed by 10:30pm EST."

... that's just it, he's not a good Christian. (or human being, or lawyer, or sore loser.)

@Mnementh2230:

And even if it did, I was hoping Jack could tell me where I can acquire a real life version of the Spartan Laser? ... Yeah, I didn't think so.
This will be a legitimate court win for Microsoft.
I'm sure we've all heard the expression 'to bite off more than you can chew' but I think the sheer proportions of this stunt warrants a new one:

'since you're already choking on a whole turkey, might as well go ahead and try to down a great whale too'.

...Hey, that means Jack finally set a precedent!

Now there is something to 'HOOAH!' about!
I assume it would be stupid to ask, "Doesn't Jack realize that teen decision-making IN GENERAL occurs in different parts of (and of different ways within) the teenage brain than it does in the adult brain?" since he obviously is a little short on his reality check.

Here it is slooooowllllly, Jack:

Teen-age-ers do not have full-ly de-vel-oped pre-front-al cor-tex-es. Or at least, they use that area of the brain for a lot of thinking and so it isn't yet specialized sufficiently to perform the same level of empathy and impulse The problem isn't that kids are being influenced more by what they take in--it's that other people's feelings and health factor less into some teens' decision-making than it should for a mentally normal adult.

Of course, people with mental disorders have weird results depending on disorder, but videogames sparking that area of the brain in normal teenagers means nothing because it is a part of the brain they rely upon more heavily than adults, and in more (nearly all) questions of choice. So if it's sparking, all that means is the teens are thinking about what they're doing, and God forbid we should encourage that.
Jack Thompson is a public nuisance. His release should be blocked in Florida.
Someone should declare Jack Thompson a public nuisance - I bet there's a case for that!!
Jack, Jack, Jack... You have brightened my day considerably. The comedy you create is hilarious. Especially because it is unintentional.
Wow Jack you think anyone gives a shit about what you think about Halo 3? Im so glad I live SO far away from Florida.You Bastard.
I would like to see the source for this comment:

"John Muhammad, knew the efficacy of the first Halo video game in this regard, because the Army in which he served used this same murder simulator to train snipers to kill. "

Or is just throwing random, made up BS ok right before you state "Under penalty of perjury, I declare the foregoing facts are true, correct, and complete, so help me God, this September 21, 2007."
@ MC117

He's royally ****ed is what he is.

And i'll say it again: this won't get to hearing. What's Thompson's definition of 'foreign'? Because that's what he's calling both Best Buy and Microsoft in that document. Last i checked, those were both American companies.
@Black Manta

If only.. Although it does sound more ABC than FOX.
Awesome! It took him a while to jump back on bashing the Sci-Fi shooter genre...looks like Doom and Quake finally are off the hook!
@steve

Causing undue stress upon others and encouraging people that disagree with him to commit suicide ("Go by a suicide game and get real good at it") is definitely detrimental to society.
@chozo_ninpo

Nice spoof, but it should be "lively-hood", which is to say a profession. Good stuff otherwise! :)
This is probably going to get throw out off the bat, but in the hopes it does go to court I am going to love watching Microsofts gold plated lawyer robots legally rape Jt to death.

Thats a picture to go on your wall.
but, as the law states, it isnt.
One hour to go Thompson. Tick Tock. But its starting to seem unlikely you will be able to stop the release. But that would be par for the course wouldn't it?
[...] ??? ??????? ?? ???? GamePolitics.com, ??????? ????? ???????? ?????? (????? ? ??????? Microsoft Word) ? ??????????? ???????? ???? Halo 3 “??????????? ????????????? ???????????”; ? ???????? ?????????? ?? ???? ????????? ???????? ???? Best Buy ? ?????????? Microsoft. [...]
As funny as this is to me (being a non halo fan) I really don't think this will go anywhere at all...Jack has no grounds and this will not even make it to a hearing.

This is just him trying to make a big name for himself in the wake of some failures against videogames.
Halo 3?

You'd think I wouldn't be surprised, but seriously...Halo 3?
Well, you know, with all the hype surrounding it, it IS starting to seem like a nuisance now...I just want it to come out already so we can be done with the pre-launch hype. ;P

(I have nothing to say on the actual lawsuit because anything I want to say has either already been said or will be said by other commenters.)
Because all these other times worked so well.
HA! Not a chance in hell! He must be really off his nut! It comes out in three days, does he really think he is going to succeed?
“Under penalty of perjury, I declare the foregoing facts are true, correct, and complete, so help me God, this September 21, 2007.” –Thompson

Oo, someone's in trouble!

Andrew Eisen
Actually as soon as I bought my copy of Halo 2, all my neighbors suddenly were unable to sleep through the night, developed a chronic lung disease, and thought it was O.K. to frag each other IRL for funsies.

So I think he could really be on to something with this public nuisance thing!
Laddy Jack thought he was in trouble in the past (well, he never really thinks he's in trouble, but we all know better)...wait till the Mighty Fist of M$ comes down from Redmond to crush him.
Stuff like Malvo training on Halo or MS’s intention to sell Halo 3 to kids is merely speculation but the complaint is chockfull of statements Thompson knows to be completely untrue. That makes them lies.

What’s he lying about?

-The conclusions of the 2005 APA resolution
-The use of brain scan studies in Roper vs. Simmons
-The conclusions of college studies (most of which aren’t even brain scan studies as he claims)
-The reasons behind the ESRB (he claims its existence is an industry acknowledgement of harm)

Andrew Eisen
It was funny enough for bully, but jack doesnt have a chance with halo 3

What were you thinking jack? days before the release, the third itteration of the game, fantasy violence where your killing aliens not people. Theres no way you can win this one.

Knowing jack he probably hopes to cry 'conspiracy!' when he inevitably fails, but halo 3 has at least enough general regonition for the public to ignore his futile and flacid attempts at noteriety.

Next time do something more itneresting jack, try convicting the scottish parliament for war crimes because they harbor that dreadful rockstar north. That crazy enough to get you in some papers.
See, this is exactly why he needs to be disbarred. At this point, he's just throwing around his legal wherever he feels like it. He's either too bull-headed or too stupid to know he should just give up.
Wait.

.........WHAT?

I guess the only reason why such complaint even exists is that MS told Quack Thompson he couldn't be the first person to play Halo 3.
*legal weight...

I hate when I think faster than I type.
holy shit, holy shit, This is the end game gents.
@Blackwolf:

LOL... with the way HALO 3 advertising is everywhere (I hear they're even teaming up with BK, as well as a NASCAR sponsor.) so maybe it is kind of a nuisance.

I suppose Jack's just as bored as we are waiting for the November funeral for his career.
I hope this news catches Bill Gates in a spiteful sort of mood.
I predict...

EEEEE PPPPP IIIII CCC
E P P I CCC
EEEEE P P I CC

FFFFF A IIIII L

This is nothing. Jack's case has even less merit than before. It'll be dismissed in days, and he can go back to spending his ample spare time trolling this site due to a lack of work.
How does picking a different game for the same lawsuit make it any more probable that it will succede? I am just totally floored that ANY ONE can take this guy seriously.
this dude is seriously jacked up in the wacko box.
Wow...he must have nothing better to do, if he's going after a game that comes out in less than a week.

Woohoo PR suicide!~

Steven Byers, formerly Novacat
If Jack Thompson really wanted to change society for the better, he would file a court injunction to ban all the 12-year-old brats from playing Halo 3 on Xbox Live. My god, those idiots are freaking annoying.
AHAHAHAHAHAHAHAHAHAHAHAHAHAAHAHAHAHHAHAHAHAHAHAHAHAHA

Aha...aha

ow my lungs hurt
i think jack thompson should be listed as an official side-effect warning by the government for people who stop taking their perscription anti-depressants and crazy pills suddenly.
You know that song 'Windmills of your Mind?'

"Round like a circle in a spiral
Like a wheel within a wheel
Never ending or beginning
On an ever-spinning reel
Like a snowball down a mountain
Or a carnival balloon
Like a carousel that's turning
Running rings around the moon......"

I think covered my thoughts on this.
This isn't even funny anymore, this is psychotic. Someone please toss him in a rubber room and get him the help he desperately needs.
A PUBLIC NUISANCE:

1)…tend[s] to annoy the community,
Hell yes

2)injure the health of the citizens in general,
Am I the only one whose smacked their heads trying to grasp his idiocy?

3)or corrupt the public morals
F*CK yes, every word out of his mouth is either hatepreaching or corruption of christian morals to suit his ego and agenda

Ladies and gentlemen get a lawyer, because we have a better case than him on this.
*I've covered my thoughts

*desperately wants an edit buton*
Maybe it's been said a crap-ton of times in the old Bully discussions, but can someone try to declare Jack thompson as a public nuisance? Sure, he may not necessarily fit the legal definition, but damned if he doesn't fit the common sense definition.
And it seems that I'm just three posts late to saying so.
Before Jack catches wind of this and starts posting, I just want to point something out.

Dennis has done a fine job here. He has made the entire document for the filing available, outlined the Public Nuisance law and what it is commonly used for, and has not degraded to petty name-calling. In short, his article is professionally written and not slighting anybody.

I just want to get that out of the way before Jack shows up and starts screaming that Dennis did it wrong, or something.
Dennis, this has to stop.

you made soda shoot out of my nose i laughed so hard.
seriously, think of the sinuses.
@Oni

nice prempt, though no one listens to jack anyway.

Dennis does a good job of covering stories in an informative and impartial manner, Ive only seen the odd comment in reference to jack that is neither abusive or stated as anything other than journalistic commentary.

Keep on truckin dennis!
@Pirra:

"In other news, the sun rose in the east this morning."
Let me start this by saying that Jack Thompson is an insufferable fool.

That being said, he has an unfortunate point about the sale of the game to minors. However, outlawing the game in the state isn't even close to a reasonable or fair restriction.

A solution that Jack might actually succeed with would be to license retailers to sell mature games much like state liquor boards license point-of-sale distributors of alcohol. Give them a license, run inspections much like Jack has with his son every once in a while, and if an individual store fails, give them a warning, cite them, and eventually remove their license to sell mature games.

It's relatively (though not entirely) effective for alcohol. The only major hurdle he would have there is getting Mature-rated (noting of course that ratings are voluntary) games to be labeled as a controlled substance.

But, since in all of his career, Jack Thompson has yet to do anything even mildly intelligent, I think we're going to watch him bash his head into the epic wall that is Halo 3.
Sometimes I want to root for Jack Thompson.

He's like that crazy hobo screaming about the end of times that you feel compelled to buy a sandwich for.

He's never won and he'll never win with gaming, so instead of getting defensive, let's just sit back and enjoy all the nonsense.
@Oni

Oh, Dennis certainly does do an excellent job, but according to Jack, unless you print his version of the facts, you aren't a journalist, or unless you got on TV, even so,he tried to get Dennis fired, twice, from two different papers, and there's the fact that anything linking to Jack's legal documents in his mind lead to porn sites is my guess.

As for my thoughts... *wipes blood form his forehead from ramming it into the wall* Is Thompson so masochistic as to want to get financially curb stomped by Microsoft. Wonderful logic, he couldn't stop a game that took place in a somewhat realistic setting, so he'll take on a game that takes place in locales that don't exist, AKA FICTION!!!!

It's official, Jack's psyche evaluation was completely and utterly biased, or he lied on it, to both. Personally. I'm betting on both, otherwise he wouldn't be so afraid of the BAR imposed evaluation, IE trying all he can to avoid it and push his hearing back.
my name is billy.
Go Jack Go!

Jack a piece of advise if I may. You might want to do this early than the weekend before a game comes out. Cause I'm sure at this point in time the game has already left the warehouse and is on its way to the stores. A game like Halo 3 already has millions of pre-orders. By the time the court actually hears your case it will be too late as the game will be in the hands of all the fans of this game. Thanks for the entertainment though.
@Seany-boy

so you're ok with the government regulating what you can and cannot play?

who do you think runs the MPAA?
You know what Jack(attorney and you're not)'s problem is? He has too many allies.

You see, after utterly destroying of 2LiveCrew, Howard Stern, Janet Reno, Take Two, Sony, Midway Games, Rockstar, The Florida Bar, gays, and the two guys who made counter-strike in their basement, the entire American public rallied behind Jack(attorney and you're not) as our savior. He prevented our children from spiraling down into the cesspool of moral debauchery known only as 'rampant-video-game-trained-and-copycatted-mass-killings'.

After burying all the foul sources of corruption who were foolish enough to stand against him, Jack(attorney and you're not) was left with nothing but the adoring masses and no one to left to challenge his insuppressible legal prowess.

So what was Jack(attorney and you're not)'s next logical move? Simple. To take on the only breeding ground of pixelated evil left, THE corporation of all corporations - MICROSOFT! Yes that's right, Jack(attorney and you're not)'s next move is to siege the last remaining bastion of virtual evil.

The battle will long and bloody to be sure, but with the support of the adoring public, the sharpest legal minds in the country (next to him of course) and most importantly the divine blessing of the one true God of one true Gods, our Hero(attorney and you're not) will once again emerge triumphant against SATANSOFT and their ordnance of murder simulators.

Amen.
@Seany-boy

Anything other than a complete and utter ban on M rated games is an unacceptable compromise.
@kurisu7885

In Jack's opinion, or your own?
@Seany-boy

I meant to say in his twisted little mind. I'm perfectly ok with M rated games and even AO rated, despite that their aren't any, so long as games such as that do not wind up in the hands of those who shouldn't play them.

@Booya

Ok, I know I am seeing the humor in your post, but I need ot be sure, sarcasm?
@kurisu7885

Valiant point. I agree. The vast majority of Jack's attempts have not been to stop vendors from selling the game from minors, but to in fact stop the game from being distributed at all, stating that the irresponsibility of the vendors is too great to allow them to inadvertently or irresponsibly sell the game to minors.

I wonder what Jack's view are on parents who buy this mature rated game for their own children? Should their children be placed into protective custody?
@Chuma

Well, since he'd have to spend money to keep his lawsuit crusade going, he might back down, and at worst, have all the bark, and even less bite than now

I doubt it though, he's too much of an imbecile to get when he's been beaten it seems.
ya, what's funny, my friend is the manager at our local movie gallery (think blockbuster). I went in today to rent eternal sonata to tide me over till tuesday, he told me the truck with all their copies of halo 3 had come in that morning =)
HA HA! I knew it! I KNEW IT! Jackie boy is just begging for that padded room in an asylum!
Okay, let's summarize:

1)It's days before the launch.
2)It's so much more fantasy than realism, that you'd have to be mentally undevelloped/ill to be influenced by it.
3) He's trying to take on Bungie and Microsoft.
4) He's doing this in the middle of his current bar case (considering that he's had complaints about this).
5) It's days before the release.

If we could sell tickets to this, we'd make a fortune. This is going to hurt his reputation, such as it is, and his cause very much. It just makes no sense. I know we don't expect it to, but this is just rediculous.

-Mike Schwinger
Some say it was a warning
Some say it was a sign
I was standing right there
When it came down from the sky
The way it spoke to us
You felt it from inside
Said it was up to us
Up to us to decide
"You've become a virus
Killing off his host
We been watching you with all of our eyes
And what you seem to value most
So much potential
Or so we used to say
Your greed, self-importance and your arrogance
You piss it all away
We heard a cry
We've come to intervene
You will change your ways and you will make amends
Or we will wipe this place clean"

Your time is ticking away
Yeah, I'd say sarcasm. ^_^
for those of you in the freespace comunity...email jack thompson a copy of just another day three with intructions on how to get freespace. he'll love it.
Not even going to bother reading his complaint, this is just hilarious. If he cared about how frivolous this was, he wouldn't have even bothered-- he's obviously just attention-whoring at this point.
Wow, Jack must be having memory loss in his old age. He was unable to prove that Bully would bring harm to the denizens of Florida and there is no way he will be able to prove the harm in this situation. That could be because there is no evidence despite what Jack claims.
Sorry for double post, we need an edit function (one with a time limit, if nothing else!)

It just occurred to me all he's going to succeed in doing is generating even more publicity for an already-anticipated game. Go go free advertising!
wow microsoft ummm would someone please remind jacky boy that microsofts warchest is MUCH larger than r*'s
If there was ever a video game franchise that actually DID promote worthwhile values, it'd be Halo. For crying out loud, Halo's violence is on an entirely different level from the likes of GTA. I guess this kinda thing should be expected after Jack started criticizing even the military . . . but, c'mon.

I'd say this is a new low, but we keep seeing one every time his name pops up on this site.
@cullarn:

well with any luck they'll bury him... and we'll all live happily ever after. :P
whats up with thompson and best buy? did he get fired from there a while back or what?
Maybe, when this is defeated, the judge can order him to retake world geography as part of his punishment :)
I just read the word document and it says the following:

"THE FACTS
8. Defendants Best Buy and Microsoft are presently selling, for delivery commencing on October 25, 2007, the violent, interactive video game” entitled Halo 3."

I thought Halo 3 came out this month? Oh man, Jack is so far up his own ass, he doesn't even check release dates anymore for the games he tries to ruin. Ultra-Fail! :p
@Vansau:

How's this for a schedule?:

Geography 101
Logic 101
Practicing Law 101
Keyboarding 101

Which makes me wonder, how'd he ever manage the High School degree, unless Mommy and Daddy paid his way through that, too.
@Adaptor

That's closer to Guitar Hero 3's release.
Wow. Well, let's hope for the worst *big grin*

This isn't Take-Two anymore, this is Microsoft. This is like biting the big ol junkyard dog on the ass. If Jack pisses them off too much, hopefully, they'll get real nasty back.
Halo 3 is a video game that allows the virtual reality player to rehearse violent acts resulting in the death of one’s virtual victims What the fuck?! you In a war jackass.
I think you guys are going to love this, I'm looking at Thompson's Complaint, and well, under "THE FACTS" I found this:

8. Defendants Best Buy and Microsoft are presently selling, for delivery commencing on October 25, 2007, the violent, interactive video game” entitled Halo 3.

Now, I don't know what world he's living in, but as far as I know, and as far as official announcements go, Halo 3 is coming out next week on the 25th. So it looks like Jacko has finally lost his sense of time.
i dont even get mad at the things he does anymore. I just laugh.
What a waste of time.

Halo 3 comes out Midnight on Tuesday, so he's way too late in that regard.

Jack Thompson is the most pathetic person in the universe. This didn't work with Bully(sure, he got the hearing, but the judge turned him down after viewing the game), what makes that motard think it will work now?
9. Halo 3 is a video game that allows the virtual reality player to rehearse violent acts resulting in the death of one’s virtual victims. Lee Boyd Malvo, the younger of the two “DC Beltway Snipers” was trained on Halo to kill residents within Virginia, Maryland, and Washington, D.C. His “mentor,” John Muhammad, knew the efficacy of the first Halo video game in this regard, because the Army in which he served used this same murder simulator to train snipers to kill. Malvo learned well on Halo. What the fuck. Halo is not an army game jack you cocksucking fuck. god damn he has lost it.
Hmm

Can we sue Jack Thompson for being a public Nuisance?

tend[s] to annoy the community
yes he sure does do that

injure the health of the citizens in general
I wonder how the health of retail store employees are doing as well as his sons mental health? And does inducing angry and frustration over his lying antics count as injuring health?

or corrupt the public morals
lying to the public, giving his child a credit card then saying any child can buy games, calling janet reno a closeted lesbian, calling Belgium's gay, clamming video games cause people to go out and murder people allowing murders to try and get off.

…any house or place of prostitution, assignation, lewdness
umm does prostituting himself for public exposure count?

or place or building where games of chance [i.e., gambling]
well we all know he is gambling since he is going up against microsoft. well he is gambling his career away. So far he hasnt lost it all, just gotta wait.

are engaged in violation of law or any place where any law of the state is violated, shall be deemed guilty of maintaining a nuisance
isnt lying to the public to get them on a "moral" crusade where there is really no danger similar to yelling fire in a theater?

so anyone wanna get that class action suit against him started?
I doubt the judges will get past the first few paragraphs, seeing as he called both Best Buy and Microsoft "foreign companies."

And Dennis, did you convert this into a word file or is that how you found it? Because that would be the best in irony if he used word to 'destroy' Microsoft.
(Sorry for double post)

Oh and Halo isn't even that bad compared to other games.
He's not playign with Blank Rome anymore, though they certainyl are a formiddable law firm. Microsoft's legal department is very large and well funded and Halo 3 is going to be a high priority. He's likely to get a big countersuit for filing nusiance suits.
Yeah...can't he just live with video games? Like if he had his way (i pray that he doesnt) eventually all we can play will be Pong, rated Mature.

Microsoft is about to release the biggest game ever, do you really think you can take it down?
Ace of sevens

Wow He is going to be gangraiped leagaly.
This is going to be epic indeed.
JT failed before anyone even read his retarded proposal. And it is technically retarded because he's being very slow int he head if he thinks people won't catch the lies all over that document.
For instance, claiming the Microsoft intends to sell Halo 3 to minors is ridiculous. Microsoft sells the games to Best Buy, minors buy them FROM Best Buy.
When will we see the end of the phrase, "selling to minors"?

Secondly, when the hell did the ESRB claim that M-rated games are 'harmful' to anyone? They've acknowledges that M-rated content is indecent and inappropriate for young children, but they've NEVER claimed that M-rated games can cause psychological damage.

Likewise, where the hell does he get off saying that the Army trains people to kill with Halo? They created America's Army for that purpose, why would they pay for someone else's product?
If he survies this I think He will go after assasins creed. But he won't.
Someone asked if there's penalties for filing frivilous lawsuits a while up there. There are; I'm not sure about all the different means one can be so penalized, but one (from http://en.wikipedia.org/wiki/Rule_11):
"Rule 11 requires all papers to be signed by the attorney (if party is represented). It also provides for sanctions against the attorney or client for harassment, frivolous arguments, or a lack of factual investigation. The purpose of sanctions is deterrent, not punitive. Courts have broad discretion about the exact nature of the sanction which can include consent to in personam jurisdiction, fines, dismissal of claims, or dismissal of the entire case. The current version of Rule 11 is much more lenient than its 1980s version. Supporters of tort reform in Congress regularly call for legislation to make Rule 11 stricter."
It exists, but it's supposedly very difficult to nail someone with it. JT's apparent waiting until less than a week before the game's release, when the release has been absurdly publicized and if he was so concerned about it he'd have known about its impending release for months now, may not help, though. Had he filed this in a timely manner the case could be resolved in advance of the game's release. As it is he's probably hoping they'll consider his case to have enough merit that they'll grant a temporary injunction while hearing the case. Underhanded, and I imagine not likely to work.
One last thought: I recall a story a while ago about a small-time company that sued Nintendo for copyright infringement - something about the Miis or some crap like that. Turns out the complaint was baseless and the plaintiffs eventually moved to have the case dismissed. Not Nintendo, though - they wanted the case to be dismissed with prejudice and I think get something for their troubles. Point being - JT, in dragging Microsoft into this, may have awakened the proverbial sleeping giant. He was able to appease T2 some time ago, but Microsoft has way more resources at their disposal and I imagine if their lawyers smell a chance to bury JT they will do so. (That, and if Microsoft proves to be the company that brings down JT for good then EVERY gamer will go out and buy a 360 in appreciation.)
"Likewise, where the hell does he get off saying that the Army trains people to kill with Halo? They created America’s Army for that purpose, why would they pay for someone else’s product?"

Honestly you can't train worth a flying fuck on either or any game. When a real gun runs out of ammo there is no "R" button to reload it. A real gun requires more dexterity than aiming with a mouse with minuscule movements of the wrist. A real gun has recoil, sometimes painfully so, that a mouse cannot duplicate. When firing a real gun you often need to take things such as your breathing and even heartbeat into account.

If anything playing these games could actually detract combat ability to a person rather than hone it. Even the most "realistic" games are so unrealistic in comparison to the real thing that if you went into a fire fight with "Grand Theft Auto" experience, well lets just say you're fucked.

Its been years and years since I shot my rifle (real life one) but one thing I do remember that video games don't take into account, gun smoke freaking burns the eyes!

A comparison would be like trying to pilot the Columbia space shuttle because you've watched every episode of Star Trek.

I want Jack to explain in detail, and support with facts just how one could feasibly get any kind of training out of these games.
Excuse me? The army trains on Halo?! Go ask anyone from the miltary if that's true, Jack. I bet it will be quite a while before they stop laughing.
Beautiful! Just Beautiful!

I wonder if he in any way, shape or form believes this will help in his bar case?

Good lord, I wish I'd known this before going out drinking.

Beautiful!
Y'know, I think Jack will succeed in this. I'm sure of it.

Oh, look! A flying pig! And there's Satan buying a snowmobile.
@Paul

Don't bother. He'll just ask Dave Grossman and get the answer he wants.
@ Baine

"Defendants Best Buy and Microsoft are presently selling, for delivery commencing on October 25, 2007, the violent, interactive video game” entitled Halo 3.”

*snicker* BFFF, HA HA HA HA HA! I honestly think that JT doesn't know when Halo 3 comes out! HA! What a dumbass!
No "Jack Thompson Says" yet? I'm disappointed.
Oh this is just plain ridiculous. The game is being marketed with the ranks of a blockbuster movie. It's rated M, the game industry equivalent of an R rated movie, and while it's ambitions are lofty for what it expects on opening day, it is possible to compare this to R rated movies that have gone the distance to become big blockbuster hits. While they may not have had as many tie ins, they have come a long way and are now well known favorites among the general adult public.

Or at least cult favorites.

Let's see:

Predator - Rated R
Alien - Rated R
Die Hard - Rated R
The Matrix - Rated R

Yes, the friggin' MATRIX moviea were Rated R! And that was a blockbuster hit that's still fresh in everyone's minds!

The content in Halo 3 is hardly that much different from the above movies. You got Master Chief, your all-around "Bruce Willis". By that I mean that he's a bad ass guy that gets the job done no matter what it takes. He's cool like that. We got intelligent aliens as the enemies in Halo, akin to the suckers from Predator, Alien, and with a nasty "battle against the humans" war just like in the Matrix.

The hype machine has tie-ins up the wa-zoo! It's own Mountain Dew flavor, promotional cups and items at Burger King, 7-11, and more! Midnight launch parties at Best Buy, Wal-Mart, Target, Circuit City, GameStops a plenty...

...and this MORON thinks he can stop it!

He has so little ground to stand on with this, that he somehow has NEGATIVE ground on this one.

1) The content in Halo 3 is nothing short of what would be found in a Rated-R humanity vs. aliens blockbuster movie. Nothing sexual or pornoraphic.

2) Halo 3 has MICROSOFT behind it, with enough money set aside for legal contests that it can BURY anyone.

3) Halo has two games before it. What makes Halo 3 worthy of a block as opposed to Halo 1 and 2?

4) If someone swears constantly in an Xbox Live game, WITH the statement that content may change in an online game BECAUSE of this very factor issued by the ESRB, whose fault is it for this foul mouthery? The game maker, or the game player?

5) How is a promotional tie-in through PRIVATE corporations worthy of being a nuisance in the PUBLIC domain?!

6) Halo 3 has no gambling.

Frankly, Halo has set more of a precedent than Jack the wanna-be Giant Killer. If he actively pursues this, he is going to be stepped on like a bug by Microsoft.

Take-Two's been known to push the edge. MS, not the way Take-Two has.

This could be the final nail in his career coffin.

And I can't wait to see it! :D

See yah Jack! It's been miserable knowing you.

~Otaku-Man
"Under penalty of perjury, I declare the foregoing facts are true, correct, and complete, so help me God, this September 21, 2007." + "8. Defendants Best Buy and Microsoft are presently selling, for delivery commencing on October 25, 2007, the violent, interactive video game” entitled Halo 3." = Trouble for Thompson...

Also getting a bar complaint not count against "in good standing with The Florida Bar"? & unless by forgein he means forgein to Florida...

Here's hoping Microsoft sues his ass for slander/defamation & gets him out of our faces for good.
XD Jack you make me ROFFLE. I can't wait to see this FAIL like everything else you have tried to do.
Man I must be ready to be a splinter cell by that very same logic.

Damn I must be one good ninja as well. Hell I bet i could carry, a rocket launcher, cardboard box, food ratios, cigarettes, grenade launchers, tranquilizer gun, pistols, nitrogen freezing equipment, ninja sword, and etc and go and face giant robots made to launch a nuclear strike, deadly assasins, a guy who can mind read where i have switch my brain from using the left and right side so he cant figure out what I m going to do, a guy who can freeze me by throwing something at my shadow, and etc.

Man I m so awesome.
Oh god, He makes me so ashamed to live in Florida.

He's like that drunk uncle that visits every thanksgiving and ruins everything.
A great example of those that don't learn from the past are doomed to repeat it.

This is a fool-hardy attempt. Jack thompson couldn't block Bully, what the hell makes him think he can block Halo 3? Not only is he going up against a company who's boss is the richest person in the world, but which judge will listen to him?...Oh, and the fact that the game is coming out in 3 days. The industry should use this embarrasing and sorry PR move as evidence in Jack's upcoming bar hearing.

@Gamepolitics
I agree with what you said in the article. What Jack is doing is not only spitting in the face of Bungie's and Microsoft's first amednment rights, but he is doing it with lies and evidence that is proven wrong. This is a man should be in jail. The industry needs to take a solid stand against these attempts of censorship.
*bangs head on the desk*

make the stupid stop. Please Lord in Heaven make the stupid stop.
Yeah, I'm pretty sure that they wouldn't block the release of Halo 3 in Florida even if their lives depended on it. You gotta start small, Jackie Boy.
.....*sob*......WHY!! DOESN'T HE SHUT THE HELL UP AND GET A LIFE?!?!......*more sobbing*
i think we should all email microsoft and demand that they take their attention off software pirates for the moment and crush this insect once and for all. if anyone has the power and resources to do it, its microsoft.
Oh, and Jackie Boy files so many damn complaints it's a wonder that they still have trees in Florida.
